Agreement to these terms
These Terms of Service (“Terms”) govern your access to and use of the Dockhand™ software, websites, and applications (the “Service”) provided by Dockhand (“Dockhand,” “we,” “us”). By accessing or using the Service, you agree to these Terms. If you use the Service on behalf of a marina or other organization, you represent that you have authority to bind that organization to these Terms.
The service
Dockhand provides software that marinas use to run launches, service, rentals, slips, storage, member clubs, and billing. We may add, change, or remove features over time, and we may set or modify limits on use of the Service.
Access requires a compatible device and internet connection. You are responsible for those and for any associated costs.
Accounts and access
You are responsible for keeping your account credentials secure and for all activity under your account. You agree to provide accurate information and to keep it up to date.
Marina administrators control which staff and members may access their marina’s workspace, and the level of that access. You must be at least 18 years old, or have the authorization of your marina, to use the Service.
Acceptable use
You agree not to misuse the Service. This includes not using it for any unlawful, infringing, or harmful purpose; not attempting to gain unauthorized access to the Service or other accounts; not interfering with or disrupting the Service; and not reverse engineering, copying, or reselling the Service except as permitted by law.
Payments and fees
Your Dockhand subscription, and any fees for optional features, are billed as described in the app. Where a marina enables online payments, member and customer payments are processed by Stripe through the marina’s own connected account; Dockhand may add a service fee on amounts it processes, as disclosed in the app.
You are responsible for any taxes associated with your use of the Service, except taxes based on Dockhand’s net income. Fees are non-refundable except where required by law or expressly stated.
Third-party services
The Service integrates with third-party providers, including Stripe (payments), Intuit QuickBooks (accounting), Supabase (database and authentication), and email/notification providers. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for third-party services.
Where you connect QuickBooks Online, Dockhand accesses your accounting data on a read-only basis to support reconciliation; Dockhand does not create, edit, or delete records in your QuickBooks company.
Your data
As between you and Dockhand, you retain ownership of the marina and member data you submit to the Service. You grant Dockhand a limited license to host, process, and transmit that data solely to provide and improve the Service, as described in our Privacy Policy.
You are responsible for the accuracy of the data you input and for having the necessary rights and consents to provide it.
Intellectual property
The Service, including its software, design, and branding, is owned by Dockhand and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. All rights not expressly granted are reserved.
Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.
Limitation of liability
To the maximum extent permitted by law, Dockhand will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data. Dockhand’s total liability arising out of or relating to the Service will not exceed the amounts you paid to Dockhand in the twelve months before the event giving rise to the liability.
Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if necessary to protect the Service or its users. Upon termination, your right to use the Service ends; you may export your data as described in our Privacy Policy.
Changes to these terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. The exclusive venue for any dispute will be the state or federal courts located in Florida, and you consent to their jurisdiction.
